UFC-Que Choisir files a complaint against 12 French banks which refuse to reimburse the scams

UFC-Que Choisir has announced that it is filing a complaint against 12 French banks for deceptive commercial practices. In a press release, she points out the many techniques used by them to avoid reimbursing victims of fraud, most often trying to invoke the responsibility of the latter in the scam.

1.2 billion euros : this is the total amount of fraud recorded by the Banque de France in 2021. Each year, scams affect more and more victims. They were 1.3 million in 2020, an increase of 161% since 2010. It must be said that the risks are increasing and that hackers are full of ingenuity to pump the bank account of their victims. Worse still, it often happens that banks refuse to refund these last.

However, the law theoretically obliges them to recover the losses of their customers in the case of a scam, with one exception: if the customer in question is considered guilty ofgross negligence, such as having transmitted his bank identifiers to the scammer. However, according to UFC-Que Choisir, banks very regularly invoke this exception to evade mandatory repaymentmost often without any valid reason.

12 French banks do not reimburse their customers who are victims of fraud

Of nearly 4,300 reports received, UFC-Que Choisir indicates that 60% relate to fraud over 4,000 euros. Some even reach several thousand euros. However, this does not prevent many banks, the Banque Postale and Crédit Agricole in the lead, from refusing to reimburse their victim customers. To do this, most of them make it appear that the client is negligentwhich the organization considers misleading since, very often, the latter has simply validated an operation by SMS.

Others believe that in cases where two-factor authentication is enabled, customers have no risk of being hacked and therefore systematically refuse to reimburse, without further explanation. Finally, some banks justify themselves by indicating that their insurance does not cover victims of fraud. “Faced with the proliferation of increasingly sophisticated frauds, we cannot allow banks to blithely free themselves from their obligation”writes Alain Bazot, president of the UFC-Que Choisir.

12 French banks are now the subject of a complaint from the organization: La Banque Postale, Crédit Agricole, Banque Populaire, BNP Paribas, Société Générale, CIC, LCL, Boursorama, ING, Nickel, Cetelem and Floa Banque.
